Structuring IRA Distributions To Prevent Penalties - Safe Harbor Planning: Some Effective Methods

IRA distribution rules are a mine field. One wrong move and you can find yourself faced with high taxes and penalties that can wipe out years of savings and investment. Complicating issues is the Darwinian evolution of IRAs which have taken place since the pioneer IRA was launched in 1974 with the enactment of the Employee Retirement Income Security Act (ERISA ). Since '74, IRA rules have changed dramatically and laws was enacted to severely punish those who don't follow the rules, to the letter of the rule. IRAs come in a lot of flavors but, for purposes of this article we will focus on the two main forms of IRAs: Traditional IRAs and Roth IRAs.

Approaches for Minimizing Penalties on Early Distributions

Generally, any distribution from an IRA before you reach age 59 1/2 is considered as an early distribution and is subject to a ten percent penalty on the taxable amount received in a distribution. There're certain IRA distribution rules that can be used to avoid the burden of this early withdrawal penalty.

1. Using IRA Funds to Buy or Construct Your First Home - Up to $10,000 may be withdrawn from an IRA as an early distribution penalty-free, as long as the distribution is used to buy, construct or repair a first home for yourself, your wife, you or your spouse's kid, you or your spouse's grandchild or you or your wife's parent or ancestor.

2. Using IRA Money for Medical Bills - Penalty-free early distributions can be made if the money are used to pay unreimbursed medical costs which exceed 7.5 percent of your adjusted total earnings. There's no requirement to itemize deductions in order to qualify for this exception.

3. Using IRA Money for Academy Costs - Conventional IRAs can also be tapped to help fund university costs; however, the taxable amount of the distributions from these IRAs shall be matter of income tax in the year of the distribution.

Roth IRA distribution rules

Roth IRAs have unique policy with respect to distributions. Contributions withdrawn aren't subject to the ten percent penalty and there's no RMD with Roth IRAs. In order for Roth IRA earnings distributions to be tax-free, the account must have been opened for five years and the distributions should be made after reaching age 59 1/2. If you meet the five-year rule but not the 59 1/2 year rule, distributions in excess of your contributions will be taxable and subject to a ten percent penalty.

1. No RMD - With Roth IRAs, there's no RMD at age 70 1/2. This means a Roth IRA owner is never required to make a distribution out of their Roth IRA. Because of this, Roth IRAs can grow, untaxed, throughout the lifetime of the owner, permitting a larger legacy for their beneficiaries.

2. 0% Effective Tax Rate - Qualified distributions from Roth IRAs are not matter of income tax...ever. This means you are unaffected by future tax increases as your effective tax rate is constantly the same...zero.

3. Conversion Chances - Beginning after January 1, 2010 anybody, irrespective of their income level, may convert conventional IRAs into Roth IRAs. The tax on the taxable income for 2010 conversions can be delayed into 2011 and 2012. If you don't have enough money set aside to do a 100% conversion you can do partial conversions.

4. University Expenses - Because Roth IRA contributions might be withdrawn, tax-free, penalty-free, at any time, this kind of contributions can be a tax-free future funding source for your child's university expenses.

Wood Fired Pizza Ovens

Today entertaining on the patio or deck many times centers around an outdoor cooking area that can be as sophisticated as an indoor kitchen with all the amenities. Now there is a trend in outdoor cooking in America to include in the repertoire an Italian wood fired pizza oven. The charm of the fire, burning our choice of indigenous hardwood, somehow makes us feel more in touch, relaxed, and poses an opportunity to experience something truly different than we’re used to. The pure art of it in the typical outdoor pizza ovens available on the market today is attractive to many who tie cooking and eating together with their fun…their enjoyment of friends and family and entertaining. Plainly said, wood fired pizza oven cooking takes our barbequing to the next level. The application for pizza and bread is always there, but I have had some of the best meat cooked by experienced chefs in a wood fired pizza oven. Therein lies a bit of a problem. The typical wood fired pizza oven is made of some sort of ceramic such as clay or brick which reaches by design temperatures that are astronomical turning out the 90 second pizza with all the blistering and panache that those who use such ovens love. Wonderful, beautiful, even exotic, but in reality the application for the outdoor cooking enthusiast is very limited. It could be suggested that a different type of outdoor wood fired pizza oven that would have a broader application may be the answer for those who are on a more limited budget, but also have an appreciation for the amenities of wood fired oven cooking. Thus, the Backyard Bistro….like other outdoor pizza ovens does pizza, bread, roasting of all kinds of meats, but also doubles as a smoker, and slow cooker and therefore the all round barbeque choice. The fire is fully controllable and indirectly applied to the oven yet with the smoke available to flavor just as in the clay or brick models. It seems a good compromise for the aspiring cooking artist who is concerned about the practicality of purchase.
